Terms of Service

1. Acceptance of Terms
By accessing or using the Kostiak Green platform ("Platform"), operated by Kostiak Systems ("Company", "we", "us", "our"), located in Asunción, Paraguay, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
2. Description of Service
Kostiak Green provides a B2B data analytics platform that delivers cannabis market intelligence to licensed cannabis retailers, brands, operators, and related businesses. Our services include real-time and near-real-time market price data, competitive benchmarking dashboards, margin analysis and alert systems, market coverage reports, data exports, and API access (Corporate plan only).
All data provided by Kostiak Green is derived from publicly available sources. We are not a cannabis retailer, distributor, or plant-touching business of any kind.
3. Eligibility and Account Registration
3.1 You must be at least 21 years of age to use this Platform.
3.2 You must be a licensed cannabis operator or a professional serving the licensed cannabis industry to subscribe to paid plans.
3.3 You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at legal@kostiak.pro of any unauthorized use.
3.4 One account per business entity. Multiple accounts to circumvent usage limits will result in immediate termination.
4. Subscription Plans and Billing
4.1 Plans. Kostiak Green offers three paid subscription tiers: Starter ($199/month), Professional ($999/month), and Corporate ($2,499/month), plus a 7-day free trial.
4.2 Free Trial. New accounts receive a 7-day free trial with full access. No credit card required. At trial end, enter payment information to continue or access reverts to read-only.
4.3 Billing Cycle. Paid subscriptions bill monthly or annually in advance, starting when your trial ends or payment is entered.
4.4 Payment Processing. All payments processed by Paddle.com, our Merchant of Record. By subscribing you also agree to Paddle's terms of service.
4.5 Price Changes. We provide 30 days notice before any price change. Continued use constitutes acceptance.
4.6 Early Adopter Commitment. Subscribers who join before May 31, 2026 receive permanent free access to our ML Price Forecasting feature at launch. Applies to active, continuous subscriptions only. Cancellation and resubscription after May 31, 2026 forfeits Early Adopter status.
5. Cancellation and Refunds
5.1 Cancellation. Cancel anytime via account settings or billing@kostiak.pro. Effective at end of current billing period.
5.2 Refund Policy. 30-day money-back guarantee for first-time subscribers. Email billing@kostiak.pro within 30 days of first paid subscription for full refund. Non-refundable after 30 days except as required by law.
5.3 Downtime Credit. Unplanned downtime exceeding 48 consecutive hours entitles you to a prorated credit for the affected period, applied to your next billing cycle.
6. Data and Intellectual Property
6.1 Our Data. All market data, analytics, reports, benchmarks, and derived metrics are the intellectual property of Kostiak Systems, including our Price-per-Gram normalization methodology, Brand Penetration Index, and all algorithmic outputs.
6.2 Your Data. You retain ownership of data you provide to us. We do not sell your proprietary business data to third parties.
6.3 License to Use. We grant a limited, non-exclusive, non-transferable license for your own internal business purposes. You may not resell, sublicense, or redistribute Platform data without express written permission.
6.4 Restrictions. You may not: scrape or systematically extract data from the Platform; use automated tools beyond normal usage; reverse-engineer our normalization algorithms; share account credentials with third parties; or use data to build a competing product.
7. Data Accuracy Disclaimer
7.1 Kostiak Green provides market intelligence based on publicly available pricing data. We cannot guarantee data is complete, current, or error-free.
7.2 All data should be treated as informational and used as one input among many in business decisions. Kostiak Green is not responsible for decisions made based on our data.
7.3 Price data reflects publicly listed prices and may not reflect actual transaction prices, promotional pricing, or member discounts.
8. Limitation of Liability
To the maximum extent permitted by law, Kostiak Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Kostiak Systems from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of applicable laws.
10. Governing Law and Disputes
10.1 Governed by the laws of the Republic of Paraguay.
10.2 Disputes resolved first through good-faith negotiation, then binding arbitration in Asunción, Paraguay.
11. Modifications
We notify you of material changes via email at least 14 days before they take effect. Continued use constitutes acceptance.
